These terms are the agreement between you and FitPact (operated by Dwayne Wilson, doing business as FitPact, 6805 Main St STE 430 PMB 780, The Colony, TX 75056, USA). By subscribing or using FitPact, you agree to them. If you do not agree, please do not subscribe.
The service
FitPact is a monthly subscription that sends you daily fitness coaching and accountability messages on WhatsApp worldwide and, once available, by text message in the United States. We do not promise any specific result, such as weight loss or a performance goal.
Pax is an AI coach
Your coach, “Pax,” is an artificial-intelligence system, not a human. Its replies are generated automatically by an AI model from the messages you send. Pax can be wrong about form, programming and facts. You decide what to do. If Pax’s advice conflicts with a doctor, clinician or qualified in-person trainer, follow them.
Who can use FitPact
You must be at least 18 years old (or the age of majority where you live, if higher) and able to enter into a contract. You must own or be authorized to use the phone number you give us, and the subscription is for you only: do not use FitPact to coach anyone else, including a minor.
Price, billing and renewal
FitPact costs $14.99 USD per month. A launch offer of $9.99 USD may apply to your first month only. Your subscription renews automatically every month and Stripe charges your payment method until you cancel. Prices are in US dollars; if your card uses another currency, your bank may convert the amount and charge its own fees. Taxes may apply where required. We will tell you in advance before we change the price for existing members.
Cancellation and refunds
You can cancel at any time. On WhatsApp, STOP turns off messages; reply CANCEL PLAN to end billing, or PAUSE for a break. By text message (US), texting STOP ends your plan and messages; text PAUSE for a break. You can also use the Stripe customer portal or email hello@fit-pact.com. Cancelling ends your plan at the end of the period you already paid for and stops future renewals. We do not automatically refund the current month, but if you ask for a refund of the current period in good faith, we will usually grant it.
If you are a consumer in the EU, EEA or UK, you may have a legal right to withdraw within 14 days of subscribing. If you ask us to start the service right away, we may deduct a proportionate amount for the days already provided, as the law allows. Nothing in these terms limits your mandatory consumer rights.
Messaging terms
- Program: FitPact daily coaching messages, check-ins and replies from Pax.
- Frequency varies: usually one daily check-in plus replies to your messages, and occasional account messages (for example, billing or cancellation confirmations).
- Msg & data rates may apply, depending on your carrier and plan.
- WhatsApp: STOP turns off messages; reply CANCEL PLAN to end billing, PAUSE for a break. Text messages: texting STOP ends your plan and messages. Text PAUSE for a break. Reply HELP for help, or email hello@fit-pact.com.
- Carriers are not liable for delayed or undelivered messages. WhatsApp use is also subject to WhatsApp’s own terms.
- Text messages (SMS) are offered in the United States only. Messaging consent is not shared for marketing; see our Privacy Policy.
Replying STOP always stops messages right away. If a charge still appears after you cancel, check the Stripe portal or email us.
Not medical advice (health disclaimer)
FitPact is a fitness accountability service. It is not medical care, physical therapy, nutrition or dietetic advice, mental-health care, or in-person personal training, and it does not diagnose, treat, cure or prevent any disease or condition.
You are responsible for deciding whether you are healthy enough to exercise. If you have a medical condition, are pregnant or postpartum, have had recent surgery or an injury, or have chest pain, dizziness or fainting, talk to a doctor or licensed clinician before you train. Stop any movement that causes sharp pain, a pop, swelling, chest pain or faintness, and seek medical help. FitPact cannot help in an emergency; call your local emergency number.
Form comments are based on a photo or a short description and can be wrong. They are not clearance to lift any weight.
Your conduct
Do not harass the service, send illegal content, try to break into accounts or systems, or send photos of other people without their permission.
Our content and yours
The FitPact name, website and coaching materials belong to us. Your messages remain yours; you give us permission to process them only to provide the service, as described in our Privacy Policy.
Liability
You take on the normal risks of exercise. To the extent the law allows, FitPact is provided “as is,” we are not liable for indirect or consequential losses, and our total liability for any claim is limited to the amount you paid us in the three months before the claim. Some places do not allow these limits, so they may not apply to you.
Governing law
These terms are governed by the laws of the State of Texas, USA, and disputes will be handled in the courts of Collin County, Texas, unless the law of your country gives you the right to bring a claim where you live. If you are a consumer outside the US, you keep the protection of the mandatory consumer laws of your country.
Changes
We may update these terms. We will post the new version here with a new date and, for important changes, message or email you. Continuing to use FitPact after the change means you accept it.
