Privacy Policy

Last updated: October 7, 2026

This policy explains what FitPact collects, why, who helps us run the service, and the choices you have. We keep it short and plain.

Who we are

FitPact is operated by Dwayne Wilson, doing business as FitPact (“FitPact”, “we”, “us”), 6805 Main St STE 430 PMB 780, The Colony, TX 75056, USA. Email: hello@fit-pact.com. For the purposes of the EU and UK General Data Protection Regulation (GDPR), we are the “controller” of your personal data.

What we collect

  • Your mobile number and country, which you give us at signup or at checkout.
  • Your messaging consent: that you agreed to receive coaching messages, and when.
  • Your messages to Pax: check-in replies, questions, the schedule, equipment and limits you tell us, and photos you choose to send (for example, for a form check).
  • Payment and billing details, collected and processed by Stripe: your name, email, billing country or address, and subscription status. Stripe holds your card details. We never see or store your full card number.
  • Delivery information from our messaging providers, such as whether a message was delivered and when.
  • Basic website data: our web host may keep standard server logs (such as IP address and browser type) for security. The site remembers your language choice in your own browser (local storage). We do not use advertising or analytics cookies.

Please do not send medical records, government IDs, or photos of other people. We do not ask for your weight, body-fat percentage, or diagnoses. If you choose to tell Pax about an injury or a health limit (for example, “my knee hurts”), we use it only to adjust your workouts. Sending it is your choice, and you can ask us to delete it at any time.

How we use it

  • To run your subscription and send the daily coaching messages you asked for, at your local time.
  • To generate Pax’s replies. Pax is an AI coach: your messages are sent to our AI provider so it can write the next reply.
  • To process payments, renewals, refunds and cancellations, and to answer support requests.
  • To keep the service secure, prevent abuse, and comply with the law, including honoring STOP requests.

We do not sell your personal information, and we do not use your messages for advertising.

Text and WhatsApp messages

When you sign up and give us your number, you ask us to send you FitPact coaching messages by WhatsApp or, in the US, by text message. Message frequency varies (usually one daily check-in plus replies to your messages). Msg & data rates may apply. Reply STOP to cancel at any time, or HELP for help. After you reply STOP we may send one message confirming you are unsubscribed.

Mobile numbers and SMS/WhatsApp opt-in consent will not be shared with third parties or affiliates for marketing purposes.

Who we share it with

We share personal data only with service providers (“processors”) that help us run FitPact, under their business terms, and only as needed for that purpose:

  • Twilio (USA): sends and receives our WhatsApp and text messages.
  • Meta Platforms / WhatsApp: carries WhatsApp messages.
  • OpenAI (USA): generates Pax’s AI replies from your messages. Under OpenAI’s API terms, data sent through its API is not used to train its models by default.
  • Stripe (USA): handles checkout, payments, subscriptions and billing records.
  • here.now: hosts this website.
  • Our email providers (Porkbun forwarding to Google Gmail), when you email us.

We may also disclose information if the law requires it, or to protect someone from serious harm.

How long we keep it

  • Messages and coaching notes: while you are a member, and for up to 12 months after you cancel (to handle refunds, support and abuse), then deleted.
  • Billing records: as long as tax and accounting law requires (often up to 7 years). Stripe keeps its own records under its policies.
  • Opt-out (STOP) records: kept so we keep honoring your request.

Our providers may keep their own logs for a limited time under their policies. You can ask us to delete your data sooner; we will tell you if something must be kept by law.

Your choices and rights

Wherever you live, you can ask us for a copy of your data, to correct it, or to delete it. Email hello@fit-pact.com with the subject “Privacy request.” We will need to confirm the request comes from the phone number or email on the account. Some US states (such as California) give you additional rights, and we will honor them.

If you are in the EU, EEA or UK (GDPR / UK GDPR)

Controller. Dwayne Wilson, doing business as FitPact, 6805 Main St STE 430 PMB 780, The Colony, TX 75056, USA. Contact: hello@fit-pact.com.

Lawful basis. We process your data:

  • to perform our contract with you (running your subscription, sending coaching messages and replies, taking payment);
  • with your consent (receiving coaching messages on WhatsApp or by text, and any health details you choose to share). You can withdraw consent at any time by replying STOP or emailing us. This does not affect processing before you withdrew;
  • and, for billing records, to meet our legal obligations (tax and accounting).

Data we hold. Your phone number, your check-in replies and other messages to Pax, any photos you send, and your consent record. Payment is handled by Stripe; we see your name, email, country and subscription status, not your full card number.

Processors. Twilio, Meta (WhatsApp), OpenAI and Stripe, as described above, plus our website host and email providers.

Retention. As described in “How long we keep it” above.

Your rights. You have the right to access your data, correct it, delete it, restrict or object to its processing, receive it in a portable format, and withdraw consent. You also have the right to complain to a supervisory authority: the data protection authority in your EU/EEA country, or the Information Commissioner’s Office (ICO) in the UK. We would appreciate the chance to fix things first, so please contact us.

International transfers. FitPact is based in the United States, and our providers process data mainly in the United States. When your data is transferred from the EU, EEA or UK to the US, we rely on the safeguards our providers offer for these transfers, such as the European Commission’s Standard Contractual Clauses (and the UK equivalents) or, where a provider participates, the EU-U.S. Data Privacy Framework and its UK Extension. You can ask us for more details.

Children

FitPact is for adults 18 and over. We do not knowingly collect data from anyone under 18. If we learn that we have, we will delete the coaching data and cancel the subscription.

Security

We use our providers’ encryption in transit (HTTPS) and access controls, and we limit who can see member data. No messaging service is perfectly secure, so please do not send anything you would not want stored in a message log.

Changes

If we change this policy, we will update this page and the date above. For important changes, we will also message or email you if we can.
